1. Acceptance of Terms

This page (together with the documents expressly referred to in it) sets out the terms and conditions (Terms) on which we sell products (Products) listed on our website www.barax.co.za (our site) to you.

These Terms apply to any contract between us for the sale of Products to you (Contract). By placing an order, you agree to be bound by these Terms.

You should keep a copy of these Terms for future reference.

We may update these Terms from time to time. The Terms in force at the time of your order will apply.

These Terms are governed by the laws of the Republic of South Africa.

  • Sizes, weights, and dimensions may vary within a reasonable tolerance.
  • Packaging may differ from what is shown online.
  • All Products are subject to availability.
  • If a Product becomes unavailable, we will notify you and issue a refund if payment has already been made.

Where necessary, we reserve the right to supply a similar product of equal or better value.


4. Personal Information (POPIA Compliance)

We process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

Your information will only be used for order processing, delivery, and communication unless you consent otherwise.


5. Eligibility

You may only purchase Products if you are 18 years or older.


6. Your Consumer Rights (CPA)

As a consumer under the Consumer Protection Act (CPA), you have the right to:

  • Receive goods that are of good quality, in working order, and free of defects
  • Receive goods that match their description
  • Return defective goods within 6 months of delivery

Nothing in these Terms limits your rights under the CPA.


7. How the Contract is Formed

  • You place an order through our website.
  • You will receive an order confirmation email (this is not acceptance).
  • A contract is formed only when we dispatch your order and send a dispatch confirmation.

If we cannot fulfil your order, we will refund you in full.


8. Pricing and Payment

  • All prices are in South African Rand (ZAR).
  • Prices include VAT (15%) unless stated otherwise.
  • Delivery fees are charged separately.
  • Payment must be made in full before dispatch.

We accept:

  • Debit/Credit Cards (Visa, Mastercard, Amex)
  • PayPal (if applicable)
  • Other local payment methods (e.g., EFT, PayFast, Ozow – if enabled)

If a pricing error occurs, we will notify you and allow you to confirm or cancel your order.


9. Delivery

  • Delivery will be made to the address you provide.
  • Risk passes to you upon delivery.
  • Ownership transfers once full payment is received.

If delivery is delayed due to circumstances beyond our control, we will notify you.

Non-Delivery

If you do not receive your order:

  • We will investigate with the courier
  • Investigations may take up to 30 business days
  • If the courier is at fault, you will receive a full refund or replacement

10. Returns & Refunds (CPA Cooling-Off Right)

10.1 Cooling-Off Period (ECTA)

For online purchases, you may cancel your order within 7 days after delivery without reason.

  • You must return the goods at your own cost
  • A full refund will be issued within 15 business days, excluding delivery costs

10.2 Faulty or Defective Products (CPA)

You may return goods within 6 months if they are:

  • Defective
  • Not as described
  • Not fit for purpose

You may choose:

  • Repair
  • Replacement
  • Refund

We will cover return shipping costs for valid claims.


10.3 Non-Returnable Items

The following cannot be returned unless defective:

  • Custom-made or personalised products
  • Digital downloads
  • Opened software/media

10.4 Return Process

11. International Orders

If you order from outside South Africa:

  • You may be liable for customs duties and taxes
  • These are your responsibility

We are not liable for delays caused by events beyond our control, including:

  • Natural disasters
  • Strikes
  • Supply chain disruptions
  • Courier delays

13. Liability

We are liable for:

  • Direct losses caused by our breach
  • Faulty or unsafe products (as required by CPA)

We are not liable for:

  • Indirect or consequential losses
  • Loss of profit or business

Nothing excludes liability for:

  • Death or injury caused by negligence
  • Fraud

15. Governing Law

  • Valid for online use only
  • One code per order
  • Cannot be combined with other offers unless stated
  • May be withdrawn at any time

If items are returned:

  • Discounts are applied proportionally
  • Refunds reflect the discounted price paid
